PittMovers Service Contract, Terms and Conditions

This Service Contract, Terms and Conditions ("Agreement") governs all moving-related services provided by PittMovers, including Labor-Only Moving Services and Chartered Moving Services. By booking, scheduling, or allowing services to begin, Customer agrees to all terms herein.

Express Online Booking Acceptance (Checkout Version)

By checking the box and completing your booking, you acknowledge and agree that:

  • PittMovers provides labor-only services and/or chartered moving services and is not a household goods carrier or motor carrier

  • PittMovers does not take possession, custody, or control of your property at any time

  • All items remain under your ownership and responsibility during the entire service

  • PittMovers does not provide cargo insurance or valuation coverage

  • You are responsible for proper packing, disclosures, access, parking, and permits

  • Deposits are non-refundable and remaining balances are due upon completion of service

  • PittMovers’ liability, if any, is limited to the amount paid for services rendered

  • You have reviewed and agree to the full PittMovers Service Contract & Terms and Conditions, including all addendums

 
Credit Card Payment Disputes & Chargebacks

  • You agree not to initiate a chargeback or payment dispute for services that were completed or made available as agreed

  • Any billing concerns must be submitted to PittMovers in writing within 24 hours of service completion

  • Initiating a chargeback without first providing PittMovers the opportunity to resolve the issue constitutes a breach of this Agreement

  • PittMovers reserves the right to submit this Agreement, time records, GPS data, photos, communications, and proof of service to the card issuer

  • You agree to be responsible for all administrative fees, chargeback fees, and costs incurred by PittMovers as a result of an invalid or improper dispute

Checking this box and submitting payment constitutes your electronic signature and full legal acceptance of these terms.

 
1. Scope of Services
1.1 Labor-Only Moving Services

Labor-Only services include physical moving labor such as loading, unloading, lifting, carrying, rearranging, packing assistance, and basic disassembly/reassembly without PittMovers providing a truck or transportation.

Customer is solely responsible for:

  • Providing a suitable truck, trailer, container, or transport vehicle

  • Ensuring the vehicle is legally parked and accessible

  • Ensuring the vehicle is safe, clean, and roadworthy

1.2 Chartered Moving Services (Truck Included)

Chartered Moving Services include moving labor and a truck arranged or chartered by PittMovers for transportation purposes only.

Important Clarification:

  • PittMovers does not take possession, custody, or control of Customer’s contents at any time

  • Transportation is provided strictly as a convenience and chartered service

  • PittMovers acts solely as a labor and coordination provider, not as a household goods carrier

2. No Bailment / No Declared Possession

At no point does PittMovers declare, accept, or assume possession, custody, or bailment of Customer’s property.

  • All items remain under Customer’s ownership, responsibility, and constructive possession at all times

  • Customer retains full control and authority over all items being moved or transported

  • This Agreement does not create a carrier–shipper relationship

3. Customer Responsibilities

Customer agrees to:

  • Accurately disclose all relevant information (stairs, elevators, distance, item weight, fragile or high-value items)

  • Ensure clear and safe access to all work areas

  • Secure parking permits, elevator reservations, and building approvals when required

  • Identify items that require special handling

  • Remove or secure hazardous materials, prohibited items, or perishable goods

PittMovers reserves the right to refuse or stop service if conditions are unsafe, illegal, or materially different from what was disclosed.

4. Prohibited & Restricted Items

PittMovers will not move or transport:

  • Hazardous materials (flammables, explosives, chemicals)

  • Firearms or ammunition

  • Illegal substances

  • Live plants or animals

  • Perishable food items

Customer assumes full responsibility if such items are packed or loaded without disclosure.

5. Standard of Care & Damage Disclaimer

PittMovers agrees to perform services using reasonable care consistent with industry standards for labor-only and chartered moving services.

5.1 Damage Limitations

  • PittMovers is not responsible for pre-existing damage

  • PittMovers is not responsible for damage caused by:

    • Poor packing by Customer or third parties

    • Structural weaknesses of furniture

    • Pressboard, particle board, or self-assembled furniture

    • Items packed by Customer

    • Normal wear and tear

5.2 No Valuation or Cargo Insurance

  • PittMovers does not provide valuation coverage or cargo insurance

  • Customer is encouraged to rely on personal insurance, renter’s insurance, homeowner’s insurance, or third-party coverage

6. Time, Rates, & Payment Terms

  • Services are billed based on the selected service package, hourly rate, or flat rate

  • Time begins when crew arrives and ends upon completion or Customer-directed stop

  • Deposits are non-refundable unless otherwise stated in writing

  • Remaining balances are due immediately upon completion of service

PittMovers reserves the right to withhold completion of service for non-payment.

7. Delays, Interruptions & Force Majeure

PittMovers is not liable for delays caused by:

  • Traffic, weather, mechanical issues

  • Building restrictions or elevator delays

  • Customer unpreparedness

  • Acts of God or events beyond reasonable control

8. Cancellation & Rescheduling

  • Cancellations within 24 hours of scheduled service may be subject to fees

  • Same-day cancellations may result in forfeiture of deposit

  • Rescheduling is subject to availability

9. Indemnification

Customer agrees to indemnify and hold harmless PittMovers, its owners, employees, contractors, and agents from any claims, damages, losses, or expenses arising from:

  • Customer’s failure to comply with this Agreement

  • Undisclosed hazardous or prohibited items

  • Third-party claims related to Customer’s property

10. Limitation of Liability

To the fullest extent permitted by law:

  • PittMovers’ total liability shall not exceed the amount paid for services rendered

  • PittMovers shall not be liable for indirect, incidental, or consequential damages

11. Right to Refuse or Terminate Service

PittMovers reserves the right to refuse, suspend, or terminate service for:

  • Unsafe conditions

  • Verbal or physical abuse

  • Illegal activity

  • Non-payment

  • Misrepresentation of job details

12. Governing Law, Venue & Regulatory Classification

This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved exclusively in courts located within Allegheny County, Pennsylvania.

Regulatory Classification Disclaimer: Customer expressly acknowledges and agrees that PittMovers is not a "Household Goods Carrier," "Motor Carrier," or "Common Carrier" as defined under Pennsylvania law or federal regulations. PittMovers provides labor services and/or chartered transportation coordination only and does not assume the legal obligations, liabilities, or duties of a carrier, warehouseman, or bailee.

13. Entire Agreement & Severability

This Agreement constitutes the entire understanding between the parties. If any provision is found unenforceable, the remaining provisions shall remain in effect.

14. Service-Specific Addendums

The following Addendums are incorporated into and made part of this Agreement.

Addendum A: Labor-Only Moving Services

This Addendum applies exclusively to Labor-Only Moving Services.

  1. PittMovers does not provide transportation, vehicles, or drivers under this service.

  2. Customer maintains exclusive control over all transportation equipment.

  3. PittMovers is not responsible for load distribution, vehicle condition, or transportation-related damage.

  4. Any damage occurring during transit is the sole responsibility of the Customer.

Addendum B: Chartered Moving Services (Truck Included)

This Addendum applies exclusively to Chartered Moving Services.

  1. Any truck provided is chartered or arranged solely for Customer convenience.

  2. PittMovers does not act as a motor carrier or shipper.

  3. Customer directs loading, routing, unloading, and final placement of items.

  4. PittMovers does not issue bills of lading, valuations, or cargo declarations.

  5. No transfer of possession, custody, or control occurs at any time.

Addendum C: Online Booking & Website Acknowledgment

  1. Online bookings constitute full legal acceptance of this Agreement.

  2. Electronic acceptance has the same force as a written signature.

  3. Customer agrees that service commencement confirms acceptance of all terms.

15. Acknowledgment & Acceptance

By booking or allowing services to commence, Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
